An Act Respecting
Extended Producer Responsibility
and Paper and Packaging

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Extended Producer Responsibility and Paper and Packaging Act.

2 In this Act, "producers" include the brand owners, first importers or manufacturers of products.

3 (1) The Government shall develop and implement an extended producer responsibility program that shifts the responsibility for end-of-life management of products in the Province from municipalities to producers.

(2) Under the program, producers

(a) must be responsible for the funding of end-of-life management of products; and

(b) may internalize the costs of end-of-life management of products as a factor of production or pass those costs on to consumers.

(3) The program must, in accordance with the Extended Producer Responsibility for Printed Paper and Packaging Resolution passed by the Nova Scotia Federation of Municipalities, ensure the implementation of legislation and regulations in support of a full extended producer responsibility for printed paper and packaging model as proposed by the Nova Scotia Federation of Municipalities.
