Explanatory Note

This Bill allows the House of Assembly to designate a committee of the House to review and scrutinize regulations and proposed regulations.

An Act to Amend Chapter 393
of the Revised Statutes, 1989,
the Regulations Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 393 of the Revised Statutes, 1989, the Regulations Act, is amended by adding immediately after Section 13 the following Sections:

    13A (1) Every regulation stands permanently referred to a committee of the House of Assembly, designated for that purpose by the House, for the purpose of reviewing and scrutinizing regulations.

    (2) The committee shall examine every regulation with particular reference to the scope and method of the exercise of delegated legislative power.

    (3) The committee shall report to the House of Assembly its observations, opinions and recommendations, including whether all or any portion of a regulation should be revoked.

    13B (1) Before making a regulation, every regulation-making authority shall report to the committee designated under subsection 13A(1) respecting the purpose, scope and effect of the proposed regulation.

    (2) The committee may hold hearings on the proposed regulation to receive submissions from the public.

    (3) The committee may make recommendations to the regulation-making authority on the content of the proposed regulation.
