Explanatory Note

This Bill amends the Employment Support and Income Assistance Act to provide that applicants are not required to apply for benefits under the Canada Pension Plan as a condition for assistance and that benefits under the Canada Pension Plan may not be considered when determining eligibility for assistance.

An Act to Amend Chapter 27
of the Acts of 2000,
the Employment Support and Income Assistance Act,
Respecting Dignity and Respect for Seniors

Be it enacted by the Governor and Assembly as follows:

1 Chapter 27 of the Acts of 2000, the Employment Support and Income Assistance Act, is amended by adding immediately after Section 7 the following Section:

    7A (1) In this Section, "benefits under the Canada Pension Plan" includes early benefits for those under the age of sixty-five years and deferred benefits.

    (2) No person applying for assistance may be required to apply for benefits under the Canada Pension Plan as a condition for the assistance or for an amount of assistance.

    (3) Benefits under the Canada Pension Plan may not be considered as chargeable income or otherwise when determining eligibility for assistance or the amount of assistance an applicant is eligible to receive.

2 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
