Explanatory Note

This Bill amends the Workers' Compensation Act to expand the list of diseases presumed to be occupational diseases for firefighters and it shortens the minimum periods of service for the presumption to apply.

An Act to Amend Chapter 10
of the Acts of 1994-95,
the Workers' Compensation Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 35A(2) of Chapter 10 of the Acts of 1994-95, the Workers' Compensation Act, as enacted by Chapter 5 of the Acts of 2003, is amended by adding "listed in subsection (3A) or" immediately after "is" the second time it appears in the second line.

(2) Subsection 35A(3) of Chapter 10, as enacted by Chapter 5 of the Acts of 2003, is amended by adding "listed in subsection (3A) or" immediately after "period" in the third line.

(3) Section 35A of Chapter 10, as enacted by Chapter 5 of the Acts of 2003, is further amended by adding immediately after subsection (3) the following subsection:

    (3A) The diseases and corresponding minimum periods of employment or volunteer work set out in the following table apply for the purposes of subsections (2) and (3):

(4) Subsection 35A(5) of Chapter 10, as enacted by Chapter 5 of the Acts of 2003, is amended by adding "consistent with subsection (3A)" immediately after "regulations" in the first line.
