An Act to Amend Chapter 3
of the Acts of 2016,
the Mineral Resources Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 14(1) of Chapter 3 of the Acts of 2016, the Mineral Resources Act, is amended by adding "to perform such duties as are assigned to the Registrar by the Minister, this Act or the regulations" immediately after "Registrar" in the first line.

2 Subsection 26(6) of Chapter 3 is amended by striking out "Subject to subsection 139(1), there" in the first line and substituting "There".

3 Subsection 37(1) of Chapter 3 is amended by

(a) adding ", under Section 32," immediately after "where" in the first line; and

(b) striking out "issue" in the first line and substituting "obtain".

4 (1) Subsection 44(2) of Chapter 3 is amended by

(a) striking out ", or a person authorized by the Minister," in the second and third lines;

(b) striking out ", or the person authorized by the Minister," in the fourth and fifth lines; and

(c) striking out ", or a person authorized by the Minister," in the sixth line.

(2) Subsection 44(3) of Chapter 3 is amended by striking out "(3)" in the second line and substituting "(2)".

5 Subsection 61(2) of Chapter 3 is repealed.

6 Subsection 62(3) of Chapter 3 is repealed.

7 Subsection 77(7) of Chapter 3 is amended by striking out "79" in the last line and substituting "77A".

8 Chapter 3 is further amended by adding immediately after Section 77 the following Section:

77A Any person aggrieved by a declaration, decision or order made by the Minister under Section 77 may appeal to the Supreme Court of Nova Scotia in accordance with Section 139.

9 (1) Subsection 79(1) of Chapter 3 is amended by

(a) striking out "or a declaration, decision or order" in the first and second lines; and

(b) striking out "Section 77" in the second line and substituting "this Act".

(2) Subsection 79(3) of Chapter 3 is amended by striking out ", and the decision of the Minister is final" in the last line.

(3) Section 79 of Chapter 3 is further amended by adding immediately after subsection (3) the following subsection:

(4) An appeal decision made by the Minister under this Section may be appealed to the Supreme Court of Nova Scotia in accordance with Section 139.

10 Subsection 88(1) of Chapter 3 is amended by

(a) adding "under Section 62" immediately after "authorization" in the first line of clause (c); and

(b) adding "under subsection 61(1)" immediately after "registration" in the first line of clause (d).
