Explanatory Notes

Clause 1 clarifies that there is no requirement to serve notice, information or documents regarding a support application hearing on the claimant.

Clauses 2 and 3 clarify that there is no requirement to serve notice, information or documents regarding a support-variation application hearing on the applicant.

An Act to Amend Chapter 9
of the Acts of 2002,
the Interjurisdictional Support Orders Act

Be it enacted by the Governor and Assembly as follows:

1 Section 10 of Chapter 9 of the Acts of 2002, the Interjurisdictional Support Orders Act, as amended by Chapter 24 of the Acts of 2012, is further amended by adding immediately after subsection (1) the following subsection:

(1A) For greater certainty, the claimant is not required to be served with the notice, information or documents referred to in clause (1)(b).

2 Section 34 of Chapter 9, as amended by Chapter 24 of the Acts of 2012, is further amended by adding immediately after subsection (1) the following subsection:

(1A) For greater certainty, the applicant is not required to be served with the notice, information or documents referred to in clause (1)(b).

3 Section 35 of Chapter 9 is amended by

(a) adding "(1)" immediately after the Section number; and

(b) adding the following subsection:

(2) For greater certainty, the applicant is not required to be served with the notice, information or documents referred to in clause (1)(b).
