Explanatory Note

This Bill amends the Civil Service Act to expand the class of veterans who are to be given preference for appointment to the Civil Service.

An Act to Amend Chapter 70
of the Revised Statutes, 1989,
the Civil Service Act

Be it enacted by the Governor and Assembly as follows:

1 Section 21 of Chapter 70 of the Revised Statutes, 1989, the Civil Service Act, is repealed and the following Section substituted:

21 (1) In this Section,

(a) "honourably released" means honourably released within the meaning of subparagraph 15.01(4)(d) of the Queen's Regulations and Orders for the Canadian Forces under the National Defence Act (Canada);

(b) "veteran" means a Canadian citizen who has rendered military service

(i) for at least three continuous years as a member of

(A) the regular force as defined in subsection 2(1) of the National Defence Act (Canada) and has been honourably released, or

(B) the primary reserve established under subparagraph 2.034(a) of the Queen's Regulations and Orders for the Canadian Forces under the National Defence Act (Canada), and if no longer serving, has been honourably released,

(ii) for at least three continuous years and whose service, in the opinion of the Minister, is equivalent to paragraph (i)(A) or (B) as a member of

(A) the armed forces of a Member State of the North Atlantic Treaty Organization, or

(B) Her Majesty's Forces as defined in subsection 2(1) of the National Defence Act (Canada), or

(iii) as a member of a class of persons designated by the regulations as having rendered meritorious service.

(2) In a competition for appointment to the Civil Service, a preference shall be given to a veteran if the veteran is selected from among the candidates qualified for the position or positions in relation to which the competition is conducted as one of the most qualified candidates and placed on an eligibility list.

2 Subsection 45(1) of Chapter 70 is amended by adding immediately after clause (c) the following clause:

(ca) prescribing classes of persons who have rendered meritorious military service;
