Explanatory Note

This Bill exempts public utilities that produce or provide thermal or geothermal energy to ten or fewer customers from regulatory oversight by the Nova Scotia Utility and Review Board.

An Act to Promote the Development
of District and Neighbourhood Geothermal
Heating and Cooling Systems

Be it enacted by the Governor and Assembly as follows:

1 Chapter 380 of the Revised Statutes, 1989, the Public Utilities Act, is amended by adding immediately after Section 2 the following Section:

3 This Act does not apply to the production, transmission, delivery or furnishing to or for the public by a public utility for compensation of either thermal or geothermal energy or heat if it is provided to ten or fewer customers.
