Explanatory Notes

Clause 1 enables the Association to be referred to as Health Association Nova Scotia.

Clause 2 widens the focus of the objects of the Association to include broader membership and services to members.

Clause 3 broadens the categories of health care organizations that the Association may join.

Clause 4 broadens the categories of organizations and the types of health care the Association may govern.

Clause 5 removes sickness and accident insurance programs from the Association's health and welfare plans and adds long-term disability.

Clause 6 requires an organization to be a member of the Association in order to participate in any of its health plans or its pension plan.

An Act to Amend Chapter 111
of the Acts of 1960,
An Act to Incorporate Nova Scotia
Association of Health Organizations

Be it enacted by the Governor and Assembly as follows:

1 Section 1 of Chapter 111 of the Acts of 1960, An Act to Incorporate Nova Scotia Association of Health Organizations, as amended by Chapter 125 of the Acts of 1974, is further amended by adding "(1)" immediately after the Section number and adding the following subsection:

(2) The Association may also be known as Health Association Nova Scotia.

2 Section 2 of Chapter 111, as enacted by Chapter 125 of the Acts of 1974, is amended by

(a) striking out clause (a) and substituting the following clause:

(a) to seek and accept membership in the Association from organizations or persons involved in health care or organizations or persons that affect the social determinants of health;

(b) striking out "sick, injured and infirm" in the first and second lines of subclause (b)(ii) and substituting "people they serve";

(c) striking out "and sickness and accident insurance programs" in the second and third lines of clause (d) and substituting ", long-term disability";

(d) striking out the period at the end of clause (j) and substituting a semi-colon; and

(e) adding immediately after clause (j) the following clauses:

(k) to provide services that best meet members' needs; and

(l) to provide services to non-members in which the benefits accrue to the members.

3 Clause 3(a) of Chapter 111 is repealed and the following clause substituted:

(a) become associated with or be a member of any provincial, national or international association of institutions involved in the delivery of health care that the Association considers advisable to carry out the objects of the Association;

4 Clause 4(a) of Chapter 111 is repealed and the following clause substituted:

(a) the membership of organizations or persons involved in health care or organizations or persons that affect the social determinants of health and their representation in the Association and for the admission, suspension and retirement of such members;

5 Section 6 of Chapter 111, as amended by Chapter 125 of the Acts of 1974, is further amended by

(a) striking out "and sickness and accident insurance programs" in the first and second lines and substituting ", long-term disability";

(b) striking out "and sickness and accident insurance programs" in the second and third lines of clause (a) and substituting ", long-term disability";

(c) striking out "and sickness insurance programs" in the second and third lines of clause (b) and substituting ", long-term disability";

(d) adding "and premiums" immediately after "contributions" in the fourth line of clause (b);

(e) adding ", administrators or service providers" immediately after "underwriters" in the second line of clause (c);

(f) striking out clause (d) and substituting the following clause:

    (d) negotiate and execute agreements with members of the Association for their participation in the said group life, long-term disability and other health and welfare plans.

6 Section 8 of Chapter 111 is repealed and the following Section substituted:

8 (1) In order to participate in group life, long-term disability and other health and welfare plans referred to in clause (d) of Section 2, an organization must be a member of the Association.

(2) In order to participate in the pension plan referred to in clause (c) of Section 2, an employee must be an employee of a sponsor of the pension plan.
