Explanatory Note

This Bill amends the Education Act to require the Minister of Education to ensure the continuation of tuition support for special education students who require the support.

An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 1 of the Acts of 1995-96, the Education Act, is amended by adding immediately after Section 5 the following Section:

6 (1) Subject to subsection (2) and notwithstanding any other enactment, the Minister shall ensure that tuition support for special needs students is provided to those special needs students who require tuition support for so long as those students require the support and until such time as the public school system has the capacity to provide a special-needs program equivalent to that provided by special-education private schools at the time this Section comes into force.

(2) The moneys required for the purpose of subsection (1) shall be paid out of moneys appropriated for that purpose by the Legislature.
