An Act to Amend Chapter 147
of the Acts of 1970,
the Saint Mary's University Act, 1970

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 147, the Saint Mary's University Act, 1970, is amended by

(a) striking out the period at the end of clause (i) and substituting a semicolon; and

(b) adding immediately after clause (i) the following clause:

(j) "the Visitor" means the Roman Catholic Archbishop of Halifax or, where the Archbishop is incapacitated or the See is vacant, the person administering the affairs of the Diocese.

2 (1) Clause 7(1)(a) of Chapter 147 is repealed and the following clause substituted:

(a) the Chancellor, the Visitor, the President and Vice-Chancellor and the Vice-Presidents;

(2) Subsection 7(3) of Chapter 147 is amended by striking out "chairman and a vice-chairman" in the second line and substituting "Chair and a Vice-chair".

(3) Subsection 7(4) of Chapter 147 is amended by striking out "his term of office, an appointed or elected" in the first and second lines and substituting "an appointed or elected Governor's term of office, the".

3 Subsection 8(1) of Chapter 147 is amended by adding immediately after clause (e) the following clause:

(ea) appoint a Governor to preside over Convocation in the absence of the Chancellor and the Vice-Chancellor;

4 Section 11 of Chapter 147 is repealed and the following Section substituted:

11 (1) The Board may appoint a person to be an honorary officer of Saint Mary's University with the title of Chancellor.

(2) The duties of the Chancellor are as prescribed by the Board from time to time and include presiding over or assisting in all ceremonies of the University, including Convocation.

5 The heading immediately preceding Section 12 of Chapter 147 is amended by adding "AND VICE-CHANCELLOR" immediately after "PRESIDENT".

6 (1) Subsection 12(1) of Chapter 147 is amended by

(a) striking out "He" in the second line and substituting "The President"; and

(b) striking out "him" in the last line and substituting "the President".

(2) Section 12 of Chapter 147 is further amended by adding immediately after subsection (1) the following subsection:

(1A) The President is the Vice-Chancellor of the University and when the Chancellor is absent or where there is a vacancy in the office of Chancellor, the Vice-Chancellor shall perform the functions of the Chancellor.

7 Chapter 147 is further amended by adding immediately after Section 12 the following heading and Section:

THE VISITOR

12 A It is the role of the Visitor to provide counsel to the University as the Visitor deems appropriate.
