Explanatory Notes

Clause 1 requires the Advisory Council on Heritage Property to meet at least quarterly.

Clause 2 requires a municipal heritage advisory committee to meet at least quarterly.

Clause 3 repeals Section 18 of the Act which permits the owner of a municipal heritage property to alter or demolish the property one year after the date of the application to alter or demolish the property and adds protection for the interior of a commercial or public building.

An Act to Amend Chapter 199
of the Revised Statutes, 1989,
the Heritage Property Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 199 of the Revised Statutes, 1989, the Heritage Property Act, is amended by adding immediately after Section 4 the following Section:

4A The Advisory Council shall meet at least quarterly.

2 Chapter 199 is further amended by adding immediately after Section 12 the following Section:

12A A heritage advisory committee shall meet at least quarterly.

3 Section 18 of Chapter 199 is repealed and the following Section substituted:

18 The Advisory Council or a heritage advisory committee, as the case may be, may recommend that the interior of a commercial or public building be protected pursuant to this Act and, notwithstanding anything contained in this Act, the provisions of this Act that apply to the exterior of a building apply to the interior of such a building.
