Explanatory Note

This Bill provides for grandparents who have guardianship of their grandchildren to receive the same payments as foster parents.

An Act to Amend Chapter 8
of the Acts of 2002,
the Guardianship Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 8 of the Acts of 2002, the Guardianship Act, is amended by adding immediately after Section 19 the following Section:

19A (1) Where the Supreme Court appoints a grandparent of a child to be the guardian of the person of that child, the Minister of Community Services shall, subject to subsection (2), make the same payments to the grandparent as the Minister would make to a foster parent under the Children and Family Services Act.

(2) The moneys required for the purpose of subsection (1) shall be paid out of moneys appropriated for that purpose by the Legislature.
