Explanatory Note

This Bill amends provisions in the Motor Vehicle Act requiring the wearing of a helmet during the riding or operation of bicycles, scooters, skate boards, in-line skates, roller skates or other prescribed devices so that the requirement applies to such riding or operation anywhere in the Province.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 170A(2) of Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, as enacted by Chapter 35 of the Acts of 1996, is amended by striking out "on a highway or on any property where the operation of bicycles is permitted" in the second and third lines.

(2) Subsection 170A(3) of Chapter 293, as enacted by Chapter 35 of the Acts of 1996, is amended by striking out "on a highway or on any property where the operation of bicycles is permitted" in the fourth and fifth lines.

2 (1) Subsection 170B(1) of Chapter 293, as enacted by Chapter 20 of the Acts of 2002, is amended by striking out "on a public street, lane, road, alley or sidewalk" in the third and fourth lines.

(2) Subsection 170B(2) of Chapter 293, as enacted by Chapter 20 of the Acts of 2002, is amended by striking out "on a public street, lane, road, alley or sidewalk" in the fifth and sixth lines.

(3) Subsection 170B(3) of Chapter 293, as enacted by Chapter 20 of the Acts of 2002, is amended by striking out "on a roadway" in the fourth and fifth lines.
