Explanatory Note

This Bill authorizes a municipal subdivision by-law to require an applicant to undertake a hydrogeological assessment to determine the impact of a proposed subdivision, and any future development resulting from it, on existing and future households in the area .

An Act to Amend Chapter 18
of the Acts of 1998,
the Municipal Government Act

Be it enacted by the Governor and Assembly as follows:

1 Section 271 of Chapter 18 of the Acts of 1998, the Municipal Government Act, as amended by Chapter 35 of the Acts of 2001, Chapter 6 of the Acts of 2001, Chapter 9 of the Acts of 2003 and Chapter 7 of the Acts of 2004, is further amended by adding immediately after subsection (8) the following subsection:

(8A) A subdivision by-law may require an applicant to undertake a hydrogeological assessment to determine the impact of the proposed subdivision, and any future development resulting from it, on existing and future households in the area.
