Explanatory Note

This Bill

(a) requires Nova Scotia Power Inc. to, in each year, establish a demand-side management plan;

(b) requires the Nova Scotia Utility and Review Board to, in each year, hold a public hearing respecting the plan and make a decision with respect to its implementation; and

(c) states that the hearing referred to in (b) may be part of a rate hearing for the utility.

An Act to Amend Chapter 380
of the Revised Statutes, 1989,
the Public Utilities Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 380 of the Revised Statutes, 1989, the Public Utilities Act, is amended by adding immediately after Section 48 the following Section:

48A (1) In this Section, "plan" means a demand-side management plan.

(2) Nova Scotia Power Incorporated shall, on or before April 1, 2006, establish a plan to be submitted for approval by the Board.

(3) In each subsequent year, or as may otherwise be ordered by the Board, Nova Scotia Power Incorporated shall submit a plan to the Board.

(4) The Board shall, in each year, review and hold a public hearing with respect to the plan and shall make such order as it determines advisable respecting the implementation of the plan, including making modifications to the plan or rewriting it.

(5) The plan may also be approved by the Board in accordance with subsection (4) during the course of a rate hearing for Nova Scotia Power Incorporated.
