An Act Respecting
Certain Trusts Administered by
the Province of Nova Scotia

Short title

1 This Act may be cited as the Hospital Trusts Act. R.S., c. 207, s. 1.

Victoria General Hospital Foundation

2 (1) The Minister of Finance shall transfer the trusts listed in Schedule "A" to this Act to the Victoria General Hospital Foundation in trust.

(2) Upon transfer of the trusts pursuant to subsection (1), the Victoria General Hospital Foundation shall administer the trusts in accordance with their terms. R.S., c. 207, s. 2.

Nova Scotia Hospital Foundation

3 (1) The Minister of Finance shall transfer the trusts listed in Schedule "B" to this Act to the Nova Scotia Hospital Foundation in trust.

(2) Upon transfer of the trusts pursuant to subsection (1), the Nova Scotia Hospital Foundation shall administer the trusts in accordance with their terms. R.S., c. 207, s. 3.

Valley Health Services Association

4 (1) Notwithstanding the Finance Act and the Nova Scotia Sanitorium [Sanatorium] Act, the Minister of Finance shall transfer the trusts listed in Schedule "C" to this Act to the Valley Health Services Association in trust.

(2) Notwithstanding the Finance Act, the Nova Scotia Sanitorium [Sanatorium] Act and An Act to Incorporate the Kentville Hospital Association, upon the transfer of the trusts pursuant to subsection (1), the Valley Health Services Association shall administer the trusts in accordance with their terms. Application to court

5 Where the Victoria General Hospital Foundation, the Nova Scotia Hospital Foundation or the Valley Health Services Association holds property pursuant to this Act and where

(a) the object of the trust has ceased to exist;

(b) the trust has become substantially incapable of performance; or

(c) the trust cannot be administered,

and the trust does not provide for such eventuality, the Victoria General Hospital Foundation, the Nova Scotia Hospital Foundation or the Valley Health Services Association, as the case may be, may apply to a judge of the Trial Division of the Supreme Court for an order directing the property held by it to be used by it to attain its objects.
