CHAPTER 139

Short title
1 This Act may be cited as the Educational Communications Agency Act. 1989, c. 5, s. 1.
Interpretation
2 In this Act,
(a) "Agency" means the Nova Scotia Educational Communications Agency established by this Act;
(b) "Board" means the Board of Directors of the Agency;
(c) "Chairman" means the Chairman of the Agency. 1989, c. 5, s. 2.
Nova Scotia Educational Communications Agency
3 (1) The Nova Scotia Educational Communications Agency is hereby established.
Composition of Agency
(2) The Agency consists of the Minister of Advanced Education and Job Training, the Minister of Education and the Minister of Transportation and Communications.
Supervision of Act
(3) The Agency has the general supervision and management of this Act and the facilities and programs approved or established pursuant to this Act.
Chairman
(4) The Minister of Advanced Education and Job Training is the Chairman of the Agency in the first year and every second year thereafter and the Minister of Education in the second year and every second year thereafter.
Reporting requirement
(5) The Agency shall report to the Governor in Council through the Chairman in accordance with the provisions of this Act. 1989, c. 5, s. 3.
Object of Agency
4 The object of the Agency is to assist education and training institutions such as schools, community colleges, museums, libraries, universities and industry in providing Nova Scotians a broad choice of, and expanded access to, education and training opportunities through the use of communication and information technology. 1989, c. 5, s. 4.
Powers of Agency
5 The Agency may
(a) provide media resources to support education and training programs;
(b) co-ordinate the educational use of broadcast facilities;
(c) provide libraries with greater access to information resources through the use of communication and information technology;
(d) provide access to computer networking and audio and video teleconferencing in support of education and training;
(e) promote co-ordinated use of communication technology;
(f) make co-operative arrangements pursuant to this Act with regional, national and international organizations and entities;
(g) encourage joint research on the use of educational technology;
(h) provide assistance with distance-education design and support;
(i) assist in the public education programs of all Government departments through the use of information and educational communication technologies;
(j) carry out such other activities as are conducive to the attainment of its objects. 1989, c. 5, s. 5.
Board of Directors
6 The Agency shall be administered by a Board of Directors consisting of the Deputy Minister of Advanced Education and Job Training and one person appointed by that Minister, the Deputy Minister of Education and one person appointed by that Minister, the Deputy Minister of Transportation and Communications and one person appointed by that Minister, and the Chairman of the Nova Scotia Council on Higher Education. 1989, c. 5, s. 6.
Advisory council
7 The Agency shall appoint an advisory council consisting of representatives of those groups and institutions served by the Agency. 1989, c. 5, s. 7.
Agreements
8 To carry out the intent and purpose of this Act, the Chairman may enter into agreements with the governments of Canada or a province, a municipality, district school board, school board, institution, corporation, association, person or group of persons. 1989, c. 5, s. 8.
Personnel
9 (1) Such persons as are necessary for the administration of this Act and the regulations shall be appointed in accordance with the Civil Service Act.
Experts
(2) Notwithstanding subsection (1), the Agency may, with the approval of the Management Board, engage upon such terms and conditions as it deems fit, the services of such professionals, technical persons or experts to advise it as it deems necessary for the efficient carrying out of this Act and the regulations. 1989, c. 5, s. 9.
Annual report
10 The Agency shall make an annual report to the Governor in Council on the activities of the Agency. 1989, c. 5, s. 10.
Regulations
11 (1) The Governor in Council may make regulations
(a) respecting agreements and instruments that may be entered into or executed by or on behalf of the Agency;
(b) prescribing the duties of the Board;
(c) describing the persons or organizations or classes of persons or organizations eligible for services of the Agency;
(d) authorizing the Agency to delegate in writing to an employee of the Agency any duty, power or function vested in the Agency pursuant to this Act;
(e) prescribing additional functions of the Board;
(f) without restricting the generality of anything contained in this Act, respecting the granting of financial assistance;
(g) defining any word or expression used but not defined in this Act;
(h) respecting any matter necessary or advisable to carry out the intent and purpose of this Act.
Regulations Act
(2) The exercise by the Governor in Council of the authority contained in subsection (1) shall be regulations within the meaning of the Regulations Act. 1989, c. 5, s. 11.
