Explanatory Notes

Clause 1 sets out the short title of this Act.

Clause 2 adds a new heading and Section to the Education Act to clarify the role and duties of school board members.

Clause 3 adds a focus on achievement of all students to the duties of school boards.

An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act,
Respecting the Clarification
of School Board Members Duties

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the School Board Members Duties Clarification Act.

2 Chapter 1 of the Acts of 1995-96, the Education Act, is amended by adding immediately after Section 63 the following heading and Section:

DUTIES OF SCHOOL BOARD MEMBERS

63A Every member of a school board shall

(a) maintain a focus on the achievement of all students enrolled in the school board's schools and programs;

(b) respect that the superintendent is responsible for the day-to-day management of the school board; and

(c) act in the best interest of the school board and carry out his or her responsibilities in a manner that assists the school board in fulfilling its duties pursuant to this Act.

3 Clause 64(2)(c) of Chapter 1 is amended by adding "and the achievement of all students enrolled in its schools and programs" immediately after "education" in the first line.
