Explanatory Note

This Bill ensures that only censures by way of a revocation of a school board member's right to sit as a member, a suspension of a member from the school board and a recommendation to the Minister that the member's seat be vacated is appealable.

An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act,
Respecting School Boards

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 52A(2) of Chapter 1 of the Acts of 1995-96, the Education Act, as enacted by Chapter 54 of the Acts of 2008, is amended by striking out "this Section" in the second line and substituting "clauses 52A(1)(b), (c) or (d)".

(2) Section 52A of Chapter 1 is further amended by adding immediately after subsection (2) the following subsection:

(3) A decision by a school board to censure a member pursuant to clause 52A(1)(a) is final and binding.
