Explanatory Notes

Clauses 1 to 11 update the Atlantic Provinces Special Education Authority Act by

(a) replacing the term "resource centre" with "centre";

(b) removing references to facilities that are no longer in operation; and

(c) adding a reference to the facility that is currently in operation.

Clause 12 repeals an unproclaimed amendment to subsection 7(1) of the Act (formerly called the Handicapped Persons' Education Act) because of subsection 7(1) being repealed and replaced.

An Act to Amend Chapter 194
of the Revised Statutes, 1989,
the Atlantic Provinces Special Education Authority Act

Be it enacted by the Governor and Assembly as follows:

1 Section 3 of Chapter 194 of the Revised Statutes, 1989, the Atlantic Provinces Special Education Authority Act, as amended by Chapter 29 of the Acts of 1990 and Chapter 53 of the Acts of 2010, is further amended by

(a) adding immediately after clause (c) the following clause:

    (ca) "centre" means a centre established for the purpose of this Act;

and

(b) striking out clause (j).

2 (1) Subsection 6(2) of Chapter 194 is amended by striking out "resource" in the fifth line.

(2) Subsection 6(3) of Chapter 194 is amended by striking out "resource" in the third line.

3 The heading immediately following Section 6 of Chapter 194 is amended by striking out "RESOURCE".

4 (1) Subsection 7(1) of Chapter 194 is repealed and the following subsection substituted:

    (1) The facility for persons with low incidence sensory impairments located at 5940 South Street in Halifax in the Halifax Regional Municipality is a centre under this Act.

(2) Subsection 7(2) of Chapter 194 is repealed.

(3) Subsection 7(3) of Chapter 194 is amended by striking out "resource" in the second line.

(4) Subsection 7(4) of Chapter 194 is amended by striking out "resource" in the first and second lines.

5 The heading immediately following Section 7 of Chapter 194 is amended by striking out "RESOURCE".

6 Subsection 9(1) of Chapter 194 is amended by striking out "resource"

(a) in the third line of clause (a); and

(b) in the first and in the fifth lines of clause (b).

7 (1) Subsection 11(1) of Chapter 194, as amended by Chapter 53 of the Acts of 2010, is further amended by striking out "resource" in the first line.

(2) Subsection 11(2) of Chapter 194, as amended by Chapter 53 of the Acts of 2010, is further amended by striking out "resource" in the first line.

(3) Subsection 11(3) of Chapter 194, as amended by Chapter 53 of the Acts of 2010, is further amended by striking out "resource" in the first line.

(4) Subsection 11(4) of Chapter 194, as amended by Chapter 53 of the Acts of 2010, is further amended by striking out "resource" in the second line.

8 (1) Clause 12(2)(d) of Chapter 194, as amended by Chapter 53 of the Acts of 2010, is further amended by striking out "resource" in the eighth line.

(2) Subsection 12(3) of Chapter 194, as amended by Chapter 53 of the Acts of 2010, is further amended by striking out "resource" in the fourth line.

9 Subsection 15(2) of Chapter 194 is amended by striking out "resource" in the seventh line.

10 Subsection 18(3) of Chapter 194 is amended by striking out "resource" in the fourth line.

11 Clause 20(c) of Chapter 194 is amended by striking out "resource" in the third line.

12 Section 5 of Chapter 53 of the Acts of 2010, An Act to Amend Chapter 194 of the Revised Statutes, 1989, the Handicapped Persons' Education Act, is repealed.
