Explanatory Note

This Bill

(a) changes the name of the Handicapped Persons' Education Act to the Atlantic Provinces Special Education Authority Act;

(b) changes "handicapped person" to "person with a low-incidence sensory impairment"; and

(c) changes "Newfoundland" to "Newfoundland and Labrador".

An Act to Amend Chapter 194
of the Revised Statutes, 1989,
the Handicapped Persons' Education Act

Be it enacted by the Governor and Assembly as follows:

1 The title of Chapter 194 of the Revised Statutes, 1989, the Handicapped Persons' Education Act, is amended by striking out "Education of Handicapped Persons" and substituting "Atlantic Provinces Special Education Authority".

2 Section 1 of Chapter 194 is amended by striking out "Handicapped Persons' Education" in the first and second lines and substituting "Atlantic Provinces Special Education Authority".

3 Section 2 of Chapter 194 is amended by

(a) striking out the second comma in the third line and substituting "and Labrador"; and

(b) striking out "handicapped persons" in the fourth and fifth lines and substituting "persons with a low-incidence sensory impairment".

4 Section 3 of Chapter 194, as amended by Chapter 29 of the Acts of 1990, is further amended by

(a) adding "and Labrador" immediately after "Newfoundland" in the third line of clause (a);

(b) striking out clause (e); and

(c) adding immediately after clause (g) the following clause:

(ga) "person with a low-incidence sensory impairment" means a person who is deaf, deaf-blind, hard of hearing, blind or visually impaired and, except in subsection (3) of Section 11, under the age of twenty-one years;

5 Subsection 7(1) of Chapter 194 is amended by

(a) striking out "hearing-handicapped" in the fourth line of clause (a) and substituting "hearing-impaired";

(b) striking out "handicapped persons" in the fifth line of clause (b) and substituting "persons with a low-incidence sensory impairment"; and

(c) striking out "handicapped" in the fifth line of clause (c) and substituting "impaired or blind".

6 (1) Subsection 11(1) of Chapter 194 is amended by

(a) striking out "handicapped person" in the third line and substituting "person with a low-incidence sensory impairment and"; and

(b) striking out "handicapped" in the last line .

(2) Subsection 11(2) of Chapter 194 is amended by

(a) striking out "handicapped person" in the third line and substituting "person with a low-incidence sensory impairment"; and

(b) striking out "handicapped" in the last line .

(3) Subsection 11(3) of Chapter 194 is amended by

(a) striking out "handicapped person" in the third line and substituting "person with a low-incidence sensory impairment"; and

(b) striking out "handicapped" in the fifth line .

(4) Subsection 11(4) of Chapter 194 is amended by

(a) striking out "handicapped person" in the third line and substituting " person with a low-incidence sensory impairment"; and

(b) striking out "handicapped" in the last line .

7 (1) Subsection 12(1) of Chapter 194 is amended by

(a) striking out "handicapped person" in the second line and substituting "person with a low-incidence sensory impairment"; and

(b) striking out "handicapped" in the last line .

(2) Subsection 12(2) of Chapter 194 is amended by

(a) striking out "handicapped person" in the second line of clause (a) and substituting "person with a low-incidence sensory impairment"; and

(b) striking out "handicapped" in the fourth line of clause (c) ; and

(c) striking out "handicapped person" in the third line of clause (d) and substituting "person with a low-incidence sensory impairment"; and

(c) striking out "handicapped" in the fourth and in the sixth lines .

(3) Subsection 12(3) of Chapter 194 is amended by

(a) striking out "handicapped person" in the second line and substituting "person with a low-incidence sensory impairment and"; and

(b) striking out "handicapped" in the fourth and in the seventh lines .

8 (1) Clause 17(1)(c) of Chapter 194 is amended by adding "and Labrador" immediately after "Newfoundland" in the second line.

(2) Subsection 17(3) of Chapter 194 is amended by adding "and Labrador" immediately after "Newfoundland" in the third line.

9 Section 19 of Chapter 194 is amended by adding "and Labrador" immediately after "Newfoundland" in the fifth line.

10 Clause 20(c) of Chapter 194 is amended by striking out "handicapped persons" in the third line and substituting "persons with a low-incidence sensory impairment".

11 Section 22(1) of Chapter 194 is amended by adding "and Labrador" immediately after "Newfoundland" in the fourth line.

12 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
