Explanatory Note

This Bill allows the Minister to give financial assistance to disabled persons who do not qualify for Canada Pension Plan disability, or private or other disability plan, benefits.

An Act to Amend Chapter 27
of the Acts of 2000,
the Employment Support and
Income Assistance Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 6(1) of Chapter 27 of the Acts of 2000, the Employment Support and Income Assistance Act, is amended by

(a) striking out "and" at the end of clause (d);

(b) striking out the period at the end of clause (e) and substituting "; and" ; and

(c) adding the following clause:

(f) provide a disability pension to disabled persons who do not qualify for Canada Pension Plan disability benefits or private or other disability plan benefits.

(2) Section 6 of Chapter 27 is further amended by adding immediately after subsection (2) the following subsection:

(3) For the purpose of clause (1)(f), where the annual income of the spouse of an applicant or recipient is less than thirty-three thousand five hundred dollars, it must not be included in chargeable income pursuant to subsection 47(1) of the Employment Support and Income Assistance Regulations.
