Explanatory Notes

Clause 1 amends Section 2 of the Forests Act which sets out the intent and purpose of the Act.

Clause 2 provides that the Minister shall endeavour to achieve the best economic use of the forests of the Province on a sustainable basis.

Clause 3 amends Section 9 of the Forests Act which sets out the forest-management techniques to be used on Crown lands.

Clause 4 sets out the effective date for two of the amendments contained in this Bill.

An Act to Amend Chapter 179
of the Revised Statutes, 1989,
the Forests Act

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 179 of the Revised Statutes, 1989, the Forests Act, is amended by

(a) adding "sustaining our forests as a multiple use resource by" immediately after "towards" in the second line;

(b) adding immediately after clause (a) the following clause:

(aa) banning clear-cutting as a harvesting method unless it can be shown that no other form of harvesting can be justified;

and

(c) striking out clause (g) and substituting the following clause:

(g) using selective harvesting methods to enhance tree growth and reduce silviculture costs;

2 Subsection 5(2) of Chapter 179 is amended by adding "on a sustainable basis" immediately after "Province" in the second line.

3 Section 9 of Chapter 179 is amended by

(a) striking out clause (a) and substituting the following clause:

(a) upon application to the Minister, permit consideration of the size and configuration of areas to be clear-cut only where no other form of forest-management technique can be justified;

and

(b) striking out clause (b).

4 Clause 2(aa), as enacted by Section 1, and clause 9(a), as enacted by Section 3, have effect on and after January 1, 2006.
