Explanatory Note

This Bill prohibits the Governor in Council from appointing a person to a position under the Public Service Act unless a competition is held for that position, except where the position is listed in the Government's Fair Hiring Policy as being outside the civil service.

An Act to Amend Chapter 376
of the Revised Statutes, 1989,
the Public Service Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 376 of the Revised Statutes, 1989, the Public Service Act, is amended by adding immediately after Section 87 the following Section:

87A The Governor in Council shall not appoint a person to a position pursuant to this Act unless a competition is held for that position, unless the position is listed as being outside the civil service in the Fair Hiring Policy approved by the Public Service Commission on March 31, 2000.
