Explanatory Note

This Bill amends the Human Rights Act to permit the rental or lease of dwelling units and the sale of condominium units exclusively for occupation by persons 55 years or older.

An Act to Amend Chapter 214
of the Revised Statutes, 1989,
the Human Rights Act

Be it enacted by the Governor and Assembly as follows:

1 Section 6 of Chapter 214 of the Revised Statutes, 1989, the Human Rights Act, as enacted by Chapter 12 of the Acts of 1991, is amended by adding immediately after clause (b) the following clauses:

(ba) in respect of accommodation, to renting or leasing only for occupancy by persons fifty-five years of age and over where all rental units in a building are rented or leased only for occupancy by such persons;

(bb) in respect of the purchase or sale of property, to selling condominium units only for occupancy by persons fifty-five years of age and over where all condominium units of a condominium corporation are sold only for occupancy by such persons;
