An Act to Enforce a Moratorium
on Strip Mines in Cape Breton

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Cape Breton Strip Mines Moratorium Act.

2 In this Act,

(a) "Cape Breton" means the Counties of Cape Breton, Inverness, Richmond and Victoria;

(b) "Director" means the Director of Mines in the Department of Natural Resources;

(c) "Minister" means the Minister of Natural Resources;

(d) "strip mine" means a mine worked by removing surface material in successive parallel strips, or in a similar manner, to expose the material being mined, and includes any kind of open-pit mine other than a quarry.

3 In the event of a conflict between this Act and the Metalliferous Mines and Quarries Regulation Act or another Act of the Legislature, this Act prevails.

4 After the coming into force of this Act, no new strip mine shall be permitted to begin, or existing strip mine to expand, operations within Cape Breton.

5 (1) Within six months of the coming into force of this Act, the Minister shall conduct public hearings, including participation by residents and businesses in Cape Breton, and make a report to the House of Assembly on the result of those hearings.

(2) The Minister shall table the report in the Assembly if the Assembly is then sitting or, if the Assembly is not then sitting, file the report with the Clerk of the Assembly.
