Explanatory Note

This Bill requires solid waste generated in a municipality to be disposed of in that municipality unless the municipality's solid waste by-law otherwise permits.

An Act to Amend Chapter 1
of the Acts of 1994-95,
the Environment Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 1 of the Acts of 1994-95, the Environment Act, is amended by adding immediately after Section 101 the following Section:

101A (1) In this Section,

(a) "municipality" means a regional municipality, an incorporated town or a municipality of a county or district;

(b) "solid waste by-law" means a by-law made pursuant to Section 325 of the Municipal Government Act.

(2) Except as otherwise provided by a municipality's solid waste by-law, all solid waste generated within the municipality must be disposed of within that municipality and no person shall export or remove that solid waste from the municipality to another municipality except as permitted by the solid waste by-laws of both municipalities.
