Explanatory Note

This Bill prohibits the transportation of nuclear material within or through the Province.

An Act to Amend Chapter 119
of the Revised Statutes, 1989,
the Dangerous Goods Transportation Act,
to Prohibit the Transportation
of Nuclear Material

1 Section 2 of Chapter 119 of the Revised Statutes, 1989, the Dangerous Goods Transportation Act, is amended by adding immediately after clause (f) the following clause:

(fa) "nuclear material" means nuclear material used or intended to be used in, or nuclear waste from, nuclear weapons;

2 Section 4 of Chapter 119 is amended by striking out "This" in the first line and substituting "Subject to Section 5A, this".

3 Chapter 119 is further amended by adding immediately after Section 5 the following Section:

5A (1) No person shall transport nuclear material within or through the Province.
(2) For greater certainty, nothing in this Section is intended to infringe upon the jurisdiction of the Parliament of Canada.

4 Subsection 6(1) of Chapter 119 is amended by adding "except Section 5A" immediately after "part" in the last line.

5 Subsection 10(1) of Chapter 119 is amended by adding "or 5A" immediately after "5" in the first line.
