Explanatory Note

This Bill makes subdivision-related amendments to the Municipal Government Act and the Halifax Regional Municipality Charter that

(a) clarify the process to claim an exemption from the subdivision approval requirements;

(b) revise the provisions respecting deemed consolidations to clarify that the lots being consolidated must be contiguous, to require that they be registered as parcels under the Land Registration Act and to remove the requirement to file a present and a consolidated description;

(c) provide that a watercourse does not subdivide a lot unless the watercourse creates a natural boundary; and

(d) permit the Registrar General appointed under the Land Titles Act to validate a subdivision that is not in compliance with the subdivision approval and exemption requirements, in certain circumstances.
