Dental Act (amended)

Explanatory Note

Clause 1

(a) requires the creation of a Registration Appeal Committee by the Provincial Dental Board; and

(b) removes the hearing of appeals respecting licensing, registration or entries on the Dentists’ Register and the Dental Assistants’ Register from the Board as the hearing of these appeals is re-assigned in Clause 3.

Clause 2 authorizes the Registrar to impose conditions or restrictions on a licence if it is necessary.

Clause 3 provides that, where conditions imposed by the Registrar or the Registration Appeal Committee have been satisfied, the annual licence shall be issued to a person to engage in the practice of dentistry.

Clause 4 provides that, where conditions imposed by the Registrar or the Registration Appeal Committee have been satisfied, the annual licence shall be issued to a person to engage in the practice of dental assisting.

Clause 5 authorizes the Registration Appeal Committee to hear appeals respecting registration, licensing or entries in Registers and makes the Committee’s decision final.

Clause 6 extends the provisions regarding evidence in legal proceedings applicable to the Dental Board’s two other committees to the Registration Appeal Committee.

Clause 7

(a) extends the powers, privileges and immunities of a commissioner to the members of the Registration Appeal Committee; and

(b) excludes the powers of contempt, arrest and imprisonment from the exercise of powers by the members of any Dental Board committee.

Clause 8 extends the secrecy provisions applicable to the Dental Board’s two committees to the Registration Appeal Committee.

Clause 9 expands the regulation-making powers of the Dental Board.
