Halifax Regional Water Commission Act (amended)

Clause 1
(a) adds to the Halifax Regional Water Commission Act definitions for “Charter”, “sewage”, “sewer”, “stormwater”, “stormwater system”, “wastewater facilities” and “water system”, taken from the Halifax Regional Municipality Charter; and
(b) replaces a reference to the Municipal Government Act with a reference to the Halifax Regional Municipality Charter.

Clauses 2 and 3 clarify details concerning the membership and functioning of the Halifax Regional Water Commission Board.

Clause 4 provides that, where there is a conflict between the Act and the Halifax Regional Municipality Charter, the Act prevails.

Clause 5 authorizes
(a) the leasing of Halifax Regional Water Commission land for wind turbines; and
(b) the generation of heat or energy from by-products of Commission water, wastewater or sewer operations, in addition to the other incidental business activities of the Commission that were authorized by the Act.

Clauses 6 and 7 change references to the Municipal Government Act to references to the Halifax Regional Municipality Charter.

Clause 8 updates the document to be followed by the Commission in preparing its financial statements and clarifies how the Commission’s surplus is to be calculated and distributed to Halifax Regional Municipality.

Clauses 9 and 10 change references to the Municipal Government Act to references to the Halifax Regional Municipality Charter and remove references to business occupancy taxation.

Clause 11 changes a reference to the Municipal Government Act to a reference to the Halifax Regional Municipality Charter.

Clauses 12 and 13 move the Commission’s exemption from liability for nuisance to a separate provision and clarify it.

Clause 14 adds accountants and actuaries to the list of professionals whose certifications or representations may be relied upon by the Commission to limit its liability and its employees’ or officers’ liability.

Clauses 15 and 16 add references to relevant Parts of the Halifax Regional Municipality Charter.
