Explanatory Note





This Bill


(a) removes a provision that makes the term of office of the Deputy Mayor the same as the term of office of the Council and replaces it with a provision that makes the term of office of the Deputy Mayor such period of time as is determined by the Council;


(b) enables the Council to prescribe additional duties and responsibilities for the Deputy Mayor;


(c) removes a provision that states that the Deputy Mayor is not entitled to any additional remuneration as such, except when acting as Mayor; and


(d) removes a provision that enables the Council to fix the salary of the Deputy Mayor when acting as Mayor and replaces it with a provision that enables the Council to fix the salary of the Deputy Mayor.




An Act to Amend Chapter 3

of the Acts of 1994,

the Cape Breton Regional Municipality Act



Be it enacted by the Governor and Assembly as follows:


1 (1) Subsection 13(2) of Chapter 3 of the Acts of 1994, the Cape Breton Regional Municipality Act, is repealed and the following subsection substituted:


(2) The Deputy Mayor serves for such term of office as the Council, by recorded resolution, determines.


(2) Subsection 13(3) of Chapter 3 is amended by adding "and shall perform and carry out such additional duties and responsibilities as the Council, by recorded resolution, prescribes" immediately after "vacant" in the last line.


(3) Subsection 13(5) of Chapter 3 is repealed.


2 Subclause 27(d)(i) of Chapter 3 is amended by striking out "when acting as Mayor" in the second line.
