Explanatory Notes

Clause 1 permits a traffic authority to designate a sidewalk or part of a sidewalk as a trail and regulate the use of bicycles on the sidewalk.

Clauses 2 and 3 increase the penalty for driving while uninsured from a minimum of $250 to a minimum of $750 for a first offence, a minimum of $1,500 for a second offence and $3,000 for a third or subsequent offence.

Clause 4 provides that the Act comes into force on proclamation.


An Act to Amend Chapter 293

of the Revised Statutes, 1989,

the Motor Vehicle Act





Be it enacted by the Governor and Assembly as follows:

1 Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, is amended by adding immediately after Section 171 the following Section:

171A Notwithstanding Section 171, a traffic authority appointed pursuant to Section 86 may

(a) designate a sidewalk or any portion thereof as a trail; and

(b) authorize and regulate the use of bicycles on such trails,

and, for greater certainty, a sidewalk so designated is subject to all other provisions of this Act.

2 Section 295A of Chapter 293, as enacted by Chapter 36 of the Acts of 1990 and amended by Chapter 24 of the Acts of 1994, Chapter 12 of the Acts of 1994-95 and Chapter 23 of the Acts of 1995-96, is further amended by striking out "or 230" in the second line.

3 Chapter 293 is further amended by adding immediately after Section 295B the following Section:

295C Any person who contravenes Section 230 is guilty of an offence and liable for the first offence to a penalty of not less than seven hundred and fifty dollars and, in default of payment, to imprisonment for a term of not less than thirty days, for the second offence to a penalty of not less than fifteen hundred dollars and, in default of payment, to imprisonment for a term of not less than sixty days, and for the third or subsequent offence to a penalty of not less than three thousand dollars and, in default of payment, to imprisonment for a term of not less than ninety days.

4 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
