An Act to Amend Chapter 103

of the Acts of 1981, the

Union of Nova Scotia Municipalities Act

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 103 of the Acts of 1981, the Union of Nova Scotia Municipalities Act, as amended by Chapter 76 of the Acts of 1992, is further amended by

(a) striking out "city" in the first line of clause (c) and substituting "regional municipality"; and

(b) adding immediately after clause (c) the following clause:

(ca) "regional municipality" means a municipal unit incorporated as a regional municipality by or pursuant to an Act of the Legislature;

2 Subsection 9(1) of Chapter 103 is amended by

(a) striking out "city" in the third line and substituting "regional municipality"; and

(b) adding "of a county or district" immediately after "municipality" in the third line.

3 Subsection 13(3) of Chapter 103 is repealed and the following subsections substituted:

(3) Only members of a council or officials of a member unit may be voting delegates at an Annual Conference or a special meeting of the Union.

(3A) For the purpose of subsection (3B), the number of residents of a municipal unit in excess of twenty-five thousand shall be as shown in population estimates made, prior to April 1st of each year, by the Department of Municipal Affairs.

(3B) At an Annual Conference or a special meeting of the Union, each member unit is entitled to five voting delegates.

(3C) Notwithstanding subsection (3B), where a member unit has more than twenty-five thousand residents, that member unit is entitled to, in addition to the five voting delegates to which it is entitled by reason of subsection (3B),

(a) that number of voting delegates equal to the whole number that is obtained by dividing the number of residents in excess of twenty-five thousand by twenty-five thousand; and

(b) one voting delegate for any remainder.

4 Subsection 27(4) of Chapter 103 is repealed and the following subsection substituted:

(4) Up to five members of the council or officials of a member unit may be voting delegates of that member unit at a regional meeting of the Region in which the member unit is located except that where the Region is comprised of one member unit, all the members of the council of that member unit may be voting delegates of that member unit.
