An Act to Amend Chapter 83

of the Acts of 1973,

the Bridgewater Parks and

Recreation Commission Act

Be it enacted by the Governor and Assembly as follows:

1 Section 1 of Chapter 83 of the Acts of 1973, the Bridgewater Parks and Recreation Commission Act, is repealed and the following Section substituted:

1 This Act may be cited as the Bridgewater Parks, Recreation and Culture Act.

2 Section 3 of Chapter 83 is amended by adding "(1)" immediately after the Section number and adding the following subsections:

(2) Notwithstanding subsection (1), on and after the first day of July, 1996, the Commission consists of ten members and shall be known as the "Parks, Recreation and Culture Commission of Bridgewater".

(3) A reference in any enactment or any document to The Parks and Recreation Commission of Bridgewater shall, as regards any subsequent transaction, matter or thing, be read as a reference to the Parks, Recreation and Culture Commission of Bridgewater.

(4) No rights, duties, obligations or liabilities of The Parks and Recreation Commission of Bridgewater are in any way affected by the change of name made by subsection (2) and those rights, duties, obligations and liabilities continue to be vested in and are binding upon it under the name "Parks, Recreation and Culture Commission of Bridgewater".

3 (1) Subsection 5(1) of Chapter 83 is amended by adding immediately after clause (b) the following clause:

(ba) one resident of the Town who is under the age of nineteen years, who shall be appointed by the Council for a term ending at the close of the first annual meeting of the Commission that is held after the appointment is made but who ceases to be a member of the Commission upon ceasing to be a resident of the Town;

(2) Subsection 5(3) of Chapter 83 is repealed and the following subsection substituted:

(3) Where a vacancy occurs on the Commission other than by reason of the expiration of the term of a member, the Mayor shall appoint a person to fill the vacancy who has the same qualifications for appointment to the Commission that qualified for appointment to the Commission the member in whose place that person is appointed and that person holds office for the remainder of the term of the member in whose place that person is appointed and, where the remainder of the term is less than one year, the remainder of the term is not part of a three-year term for the purpose of subsection (2).

(3) Subsection 5(6) of Chapter 83 is amended by striking out "his duties" in the third line and substituting "the member's".

4 Section 6 of Chapter 83 is repealed and the following Section substituted:

6 Five members of the Commission constitute a quorum for the transaction of business.

5 Subsection 8(1) of Chapter 83 is amended by striking out "Town Clerk, or at his request, the Deputy Clerk" in the first line and substituting "Director of Finance and Administration".

6 (1) Subsection 9(1) of Chapter 83 is amended by

(a) striking out ", museums" in the first and second lines of clause (a); and

(b) striking out clause (d).

(2) Subsection 9(2) of Chapter 83 is amended by

(a) striking out "Clerk" in the third line and substituting "Manager"; and

(b) striking out "by him" in the third line.

7 Section 11 of Chapter 83 is amended by striking out "calendar year" and substituting "fiscal year of the Town".

8 Section 12 of Chapter 83 is amended by striking out "thirty-first day of January" in the first and second lines and substituting "thirtieth day of June".

9 (1) Subsection 13(1) of Chapter 83 is amended by striking out "thirty-first day of January" in the first and second lines and substituting "thirtieth day of June.

(2) Subsection 13(3) of Chapter 83 is amended by striking out "Treasurer" in the first line and substituting "Director of Finance and Administration".

10 Section 15 of Chapter 83 is amended by

(a) striking out "museums," in the third line of clause (a); and

(b) adding "and culture" immediately after "recreation" in clause (b).

11 (1) Subsection 17(2) of Chapter 83 is amended by striking out "in his hands" in the fourth line and substituting "so held".

(2) Section 17 of Chapter 83 is further amended by striking out "Treasurer" wherever it appears in that Section and substituting in each case "Director of Finance and Administration".

12 Section 20 of Chapter 83 is repealed.

13 Chapter 83 is further amended by

(a) striking out "Chairman" wherever it appears and substituting in each case "Chair";

(b) striking out "Vice-Chairman" wherever it appears and substituting in each case "Vice-chair"; and

(c) striking out "workmen" wherever it appears and substituting in each case "workers".
